Privacy Policy and Personal Data Processing
Please read the following carefully as you agree to the terms of this Policy by providing your Personal Data to Operator.
SECTION 1 - GENERAL TERMS
This Privacy Policy is compiled in accordance with the Federal Law No.152-FZ of 27.07.2006 «On Personal Data» («PD Law») and defines the procedure for Personal Data Processing («PDP») and measures to ensure the security of Personal Data («PD») taken by Author - Talina Malinovska («Operator») when offering Services and website www.talinamalina.art («Site»).
1.1. Operator's primary goal and condition for all actions is to observe the rights and freedoms of Users regarding their PD, including personal privacy protection.
1.2. This Policy of PDP («Policy») applies to all information that Operator may receive about Users - visitors to this Site and persons who requested Operator's Services and Artworks in any way.
1.3. User expresses and confirms his unconditional acceptance of this Policy when applying for Operator's Artworks, Services and Site. If User does not agree to all the terms of this Policy then he should not access this Site or use Operator's Services and Artworks.
SECTION 2 - OPERATOR BASIC RIGHTS AND OBLIGATIONS
2.1. Operator has the right to:
– obtain true and reliable PD and/or documents containing PD from User;
– continue PDP without the User's consent for the reasons stated in the PD Law even in case User withdraws consent to his PDP;
– determine the structure and list of measures necessary and sufficient to fulfill obligations provided for by the PD Law and other relevant legal acts.
2.2. Operator is obliged to:
– provide User with information concerning his PDP upon request;
– Process PD in accordance with the procedure established by the current legislation;
– respond to requests from Users and their legal representatives in accordance with the PD Law;
– provide necessary information to the bodies authorized for the protection of User's personal rights within 10 days from the request date;
– publish or otherwise ensure unrestricted access to this Policy;
– take legal, organizational and technical measures to protect PD from unauthorized or accidental access, destruction, modification, copying, disclosure and other illegal actions;
– cease PD transfer (distribution, disclosure, providing access), stop processing and erase PD under the procedure and in the cases provided for by the PD Law;
– fulfill other duties stipulated by the PD Law.
SECTION 3 - USER BASIC RIGHTS AND OBLIGATIONS
3.1. User has the right to:
– obtain information concerning his PDP, except in cases provided for by federal laws (the information provided to User by Operator shall be in accessible form, which shall not contain PD related to other Users unless otherwise stated by law);
– demand that Operator confirm, block, delete or update PD, as well as take measures provided by law to protect User's rights;
– withdraw consent to PDP and exercise other rights provided for by the current legislation.
3.2. User is obliged to provide Operator with reliable PD, as well as to inform Operator about the clarification (updating, modification) of his PD if needed.
3.3. Users who provide Operator with inaccurate/false PD about themselves or PD of other Users without their consent are subject to liability in accordance with the current legislation.
SECTION 4 - PD PROCESSED BY OPERATOR
4.1. Operator may Process the following PD of User: full name, date of birth, phone number, e-mail address, registration address, identity document details.
4.2. Please note that Site also collects and processes anonymous user Data (such as IP-address, browser data, website statistics, including «cookies» etc.) via internet statistics services (Google Analytics, Yandex Metrica and others).
SECTION 5 - TYPES AND PURPOSES OF PDP
5.1. Operator carries out the following types of PDP: collection, recording, systematization, accumulation, storage, clarification, extraction, use, transfer (provision, providing access), depersonalization, blocking, deletion, destruction.
5.2. Purpose of User's PDP:
— providing User with access to Operator's Services, Artworks and Site;
— conclusion, execution and termination of civil contracts with User;
— identification of User who requested Artworks and Services from Operator and notifying User about order status in Operator's system;
— processing payments from Users for Artworks and Services of Operator;
— providing Users with feedback, sending advertising and informational materials about new Artworks and Services, special offers and events (User can refuse advertising messages by notifying Operator via art@talinamalina.art marked as «Unsubscribe from notifications and special offers»);
— conducting surveys and quality assessment of services, as well as marketing, statistical and other research;
5.3. Depersonalized User Data collected through web analytics services shall be used to improve the quality and content of Site.
SECTION 6 - LEGAL BASIS FOR PDP
6.1. Operator Processes PD based on:
— federal laws and other regulatory legal acts in the field of PD protection;
— contracts concluded between Operator and User or in the interests of User;
6.2. Operator Processes User's PD entered and/or sent through special forms on Operator's Site, as well as sent to Operator in any available way by User or his legal representative acting in the interests and on behalf of User. By filling out the appropriate forms and/or sending PD to Operator, User expresses his unconditional consent to this Policy.
6.3. Operator Processes depersonalized Data about User if allowed by User’s browser settings («cookies» and JavaScript enabled).
SECTION 7 - PRINCIPLES AND CONDITIONS OF PDP
7.1. Operator Processes PD on a legal and fair basis and is limited to achieving specific, predetermined and legitimate goals. Processing of PD incompatible with the purposes of PD collection is not permitted. Combining databases containing PD processed for purposes mutually incompatible is not allowed.
7.2. The content and volume of PD correspond to the stated purposes of Processing.
7.3. During PDP the accuracy of PD, sufficiency and relevance to the purposes of PDP are ensured. Operator takes all necessary measures to delete or clarify incomplete or inaccurate Data.
7.4. PD is stored in a form that makes it possible to identify User for no longer than the purposes of Processing require. PD being Processed is destroyed or depersonalized upon achievement of Processing goals or loss of the need to achieve these goals, unless otherwise provided by federal law.
7.5. Operator Processes PD if it is necessary for:
— achieving the goals specified by law for the functions, powers and duties assigned to Operator by the current legislation;
— administration of justice or execution of a judicial act in accordance with the current legislation on enforcement proceedings;
— execution of an agreement to which User is a party, beneficiary or guarantor, as well as for concluding an agreement on the initiative or in the interests of User;
— exercising the rights and legitimate interests of Operator or third parties, or to achieve socially significant goals, provided that the rights and freedoms of User are not violated.
7.6. Operator has the right to Process PD, access to which is provided by User to an unlimited number of persons or at his request (publicly available PD). Operator has the right to Process PD subject to publication or mandatory disclosure in accordance with federal law.
SECTION 8 - PROCEDURE OF PDP
8.1. The security of PD is ensured by Operator through legal, organizational and technical measures necessary to fully comply with the requirements of current legislation in the field of PD protection. Operator ensures the safety of PD and takes all possible measures to exclude access of unauthorized persons.
8.2. Operator does not transfer User's PD to third parties, except in cases specified in current legislation or if User consents to Operator transferring data to a third party to fulfill obligations under a civil contract.
8.3. In case of inaccuracies in PD User can update them independently by notifying Operator via art@talinamalina.art marked as «PD update».
8.4. The duration of PDP is determined by the achievement of the purposes for which the PD was collected, unless another period is stipulated by the contract or applicable legislation. User can revoke his consent to PDP at any time by notifying Operator via art@talinamalina.art marked as «Withdrawal of consent to PDP».
8.5. All information collected by third-party services (including payment systems, communication facilities) and other service providers is stored and processed by these services (operators) in accordance with their User Agreement and Privacy Policy. Operator is not responsible for the actions of third parties and service providers specified in this paragraph.
8.6. The prohibitions established by User on the transfer (other than granting access), as well as on the Processing or conditions of Processing of PD permitted for distribution, do not apply in cases of state and other public interests defined by current legislation.
8.7. The cases of PDP termination are: the achievement of the purposes of Processing, the expiration of User's consent, the withdrawal of consent by User or the requirement to terminate PDP, as well as the identification of unlawful PDP.
8.8. Operator performs mixed and automated PDP with receiving and transmitting information via telecommunication networks.
SECTION 9 - PD CONFIDENTIALITY
9.1. Operator ensures the confidentiality of User's PD while Processing.
9.2. Operator and other persons who obtain access to User's PD are obliged not to disclose PD to third parties without User's consent, unless otherwise provided by federal law.
SECTION 10 - FINAL PROVISIONS
10.1. User may obtain any clarifications related to PDP by contacting Operator via the email address art@talinamalina.art.
10.2. This document shall reflect any changes to this Privacy Policy and Personal Data Processing by Operator. The Policy comes into force when User first visits the Site of Operator or otherwise requests Operator's Services and Artworks. It remains valid indefinitely until a new version of this Policy is published.
10.3. Operator has the right to make changes to this Policy at any time without written notification to User. The current version of Policy is freely available on the Internet at www.talinamalina.art/policy. By accessing Operator's Site or requesting Operator's Services and Artworks, User undertakes to independently monitor changes in this Policy and stop using Operator's Site, Artworks and Services in case of disagreement with any provision of this Policy.
